Welcome to Grave Pixel. These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our services, you agree to be bound by these Terms.

1. Services

Grave Pixel provides web design, development, hosting, and digital marketing services. The specific scope of services will be outlined in individual project proposals and contracts.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

2. User Responsibilities

When using our services, you agree to:

  • Work will meet industry standards and best practices
  • Delivered work will be free from defects for 30 days after launch

EXCEPT AS EXPRESSLY PROVIDED, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

We do not guarantee specific business results, traffic levels, or search engine rankings. Website performance depends on many factors outside our control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not liable for loss of profits, revenue, data, or business opportunities

11. Indemnification

You agree to indemnify and hold harmless Grave Pixel from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of our services, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) content you provide that infringes on third-party intellectual property rights.

12. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of our working relationship. This obligation continues for two years after project completion.

Confidential information does not include information that: (a) is publicly available, (b) was known prior to disclosure, (c) is independently developed, or (d) must be disclosed by law.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Washington, United States without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved in the courts of Washington.

14. Dispute Resolution

In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation. If negotiation fails, parties agree to mediation before pursuing litigation.

15. Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, labor disputes, government actions, or failures of third-party services.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

For active projects, modifications will not apply retroactively without mutual written agreement.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms remain in full force and effect.
